BOTH CLAIM THE LAND
Contention Between Two Estates Over a Piece of Property on River Street.
A suite entitled Thomas Brogan, jr., vs. G. E. Herrick, administrator, was begun yesterday in court of common plea. The action involves a dispute between the heirs of Thomas Brogan and those of Henry F. Clock and Anna M. Clark. Both claim ownership to real estate located on River street and worth about $5,000. The Brogan heirs are Thomas Brogan, jr., Maggie Lawlar, Bridget Dooley, Mary Brogan and Mary A. Kane. The Clakrs heirs are Mary E. Pollock, Eliza S. Clark, Robert Clark, Julian C. Clark and Anna C. Getzendanner. The Clarks heirs assert that the Brogans have been in possession of a lease, which the latter deny, saying that they know of no lease and that if one exists it is fraudulent. Mr. Herrick, as administrator of the Clark estate, has sold the property, or part of it to Mary E. Pollock and she has begun forcible detainer proceedings under the lease against the Brogans in Just Griswold’s court. The forcible detainer processing is set for hearing on Monday and the common please court is asked to enjoin its procedure. Judge Solders will pass upon the matter at noon today.
